Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website rcore.io and the AI-powered messaging and automation services provided by RCORE ("RCORE", "we", "us", or "our"), including services delivered over WhatsApp (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

RCORE provides AI-powered messaging, automation, and related services. We may add, modify, or remove features, or suspend the Services, at any time.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and able to enter into a binding contract to use the Services. By using the Services, you confirm that you meet these requirements.

3. Messaging and consent

Where the Services involve messaging over WhatsApp or other channels:

• You will only receive messages from us, or from businesses using our Services, where you have opted in or there is another lawful basis to contact you.
• You can opt out at any time by replying STOP (or the equivalent for your channel) or by emailing hello (at) rcore.io.
• Your use of WhatsApp is also subject to Meta's and WhatsApp's own terms and policies, which apply in addition to these Terms.

4. Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose;
• Send spam, unsolicited messages, or content that infringes the rights of others;
• Transmit malware, viruses, or any harmful code;
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services or related systems;
• Use the Services in a way that violates Meta's or WhatsApp's policies.

5. Intellectual property

All content, software, and materials that make up the Services are owned by RCORE or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our permission.

6. Third-party services

The Services rely on third-party platforms, including the WhatsApp Business Platform operated by Meta. We do not control and are not responsible for those platforms. Your use of them is governed by the respective third party's terms and privacy policies.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any AI-generated output will be accurate or fit for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, RCORE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to indemnify and hold RCORE harmless from any claims, damages, liabilities, and expenses arising out of your misuse of the Services or your breach of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms, misuse the Services, or where required to comply with the law. Provisions that by their nature should survive termination will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. The updated version is effective when posted at rcore.io, indicated by a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Poland, without regard to its conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the competent Polish courts.
